The Premier League's Key Match Incidents Panel ruled 4-1 that referee Tony Harrington should have awarded Brentford a penalty for foot-on-foot contact by Bogle on Schade in the 66th minute of their August 30 1-1 draw at Leeds.
However, they voted 3-2 that the error wasn't clear and obvious enough for VAR to intervene, leaving the result unchanged after Leeds equalized late.
Fans and pundits reacted with frustration from Brentford over VAR inconsistencies, while Leeds backers called the contact soft, highlighting ongoing debates about the technology's strict thresholds.
"There was foot on foot contact instigated by Bogle with enough contact for a penalty kick," the KMI Panel noted.
"However, given the high threshold for VAR intervention, the panel felt the referee's call should remain on field as it wasn't a clear and obvious error."
